Chapter 1 General Provisions
Article 1 [Purpose and Scope of Application]
① The purpose of these Terms and Conditions is to define the rights and obligations between the Company and Membership Members, as well as other necessary matters, in relation to the use of the paid subscription product, the Membership Service, provided within the Mnet Plus service operated by CJ ENM Co., Ltd. (hereinafter the "Company").
② These Terms and Conditions are individual terms and conditions regarding the paid service, Membership, among the Mnet Plus Service Terms and Conditions (hereinafter the "Basic Terms"), and with respect to the use of the Membership Service, these Terms shall take precedence over the Basic Terms.
③ Matters not specified in these Terms and Conditions shall be governed by the Basic Terms and applicable laws and regulations.
④ The Company may determine the contents of these Terms differently in accordance with the relevant laws and regulations of the country or region where the Membership Service is used, and in such cases, the laws of the relevant country or region shall take precedence over these Terms.
Article 2 [Definitions]
① The definitions of terms used in these Terms are as follows:
1. "Membership Service" means a paid service in which the Company provides certain benefits, including premium features, to members who have paid the membership fee on a recurring subscription basis by subscription period.
2. "Membership Member" means a member who has agreed to these Terms and Conditions and has entered into a Membership Service use agreement by paying the membership fee.
3. "Membership Fee" means a fixed amount paid by a Membership Member to the Company for the subscription period in order to use the Membership Service.
4. "Subscription Period" means the period from the date of payment of the Membership Fee to the day before the next scheduled payment date, during which the Membership Member may use the Membership Service (monthly, annually, or other period units).
5. "App Market Operator" means mobile app market operators designated by the Company, such as the App Store operated by Apple Inc. and Google Play operated by Google LLC.
② Terms not defined in these Terms shall follow the definitions set forth in the Basic Terms.
Chapter 2 Membership Subscription and Payment
Article 3 [Membership Subscription and Formation of Use Agreement]
① A member who wishes to subscribe to the Membership Service may apply for use of the Membership Service by confirming and agreeing to the contents of these Terms and Conditions and paying the Membership Fee in accordance with the payment procedures determined by the Company or the App Market Operator.
② The Membership Service use agreement shall be formed at the time the Company accepts the member’s application and the payment is successfully completed.
③ The Company may refuse or reserve acceptance of an application in any of the following cases, and may terminate the use agreement if any of the following reasons are confirmed after acceptance:
1. If the applicant is under 19 years of age pursuant to Article 4 Paragraph 3
2. If payment has not actually been made or there is a possibility that payment will not be made
3. If the Company determines that there is a reasonable ground not to accept the application as it violates these Terms or constitutes an unlawful or improper application
④ The Membership Service may be subscribed to only once per account, and the same member may not use the Membership Service simultaneously with two or more accounts.
Article 4 [Conditions for Use of Service]
① The Membership Service may only be used by members who have subscribed to the Mnet Plus service and have entered into a Membership Service use agreement pursuant to Article 3.
② The Membership Service may only be used in countries and regions designated by the Company. The countries and regions where the Membership Service is provided and the Membership Fees for each country/region may be confirmed on the service information page.
③ The Membership Service is not provided to users under 19 years of age. If it is confirmed that a user under 19 has paid the Membership Fee, the Company may cancel the use agreement and refund the payment amount.[S&K1]
[④ In order for a minor under the age of 19 to use the Membership Service, consent from a legal guardian (such as a parent) must be obtained. If a minor under the age of 19 pays the Membership Fee without the consent of a legal guardian, the minor or the legal guardian may cancel the use agreement. However, if the minor uses deception, such as stealing the information of an adult or using an adult’s payment information, to make the Company believe that the minor is an adult or has obtained consent from a legal guardian, the use agreement may not be unilaterally canceled.]
④ The Membership Service may be used on devices and operating system environments designated by the Company. Details regarding supported devices and environments may be confirmed on the service information page, and use of the service may be restricted on some devices due to changes in the supported environment.
⑤ The right to use the Membership Service belongs to the Membership Member’s account and may only be used on the account linked at the time of subscription. The right to use the Membership Service may not be transferred to another account.
Article 5 [Payment Methods and Payment Process]
① Payment of the Membership Fee shall currently be made only through in-app payment (hereinafter "IAP") provided by the App Market Operator. The Company may add or change available payment methods according to its operational policy, and in such cases, will notify in advance through service announcements.
② If payment is made through IAP, except where specified by applicable laws or these Terms, the processing of the Membership Fee and related refunds shall be handled according to the payment and refund policies of the App Market Operator (App Store or Google Play, etc.) through their payment systems.
Article 6 [Fees, Auto-Renewal, and Payment Date]
① The Membership Service is an auto-renewing subscription product, and the Membership Fee will be automatically renewed and charged periodically upon expiration of the subscription period.
② The recurring payment date is automatically set as the date corresponding to the initial subscription date (or the date specified by the service). If such a date does not exist in a particular month, payment shall be made on the last day of that month.
③ Unless canceled at least 24 hours before the end of the current subscription period, the Membership Service will automatically renew at the same Membership Fee. The renewal fee will be charged within 24 hours prior to the end of the subscription period using the registered payment method.
Article 7 [Payment Failure and Grace Period]
① If payment cannot be successfully processed on the scheduled payment date using the registered payment method, the Company may attempt to reprocess the payment during a certain period (hereinafter the "Grace Period") while maintaining Membership Service benefits.
② If payment is completed within the Grace Period, the Membership Service will continue without interruption. If payment is not completed within the Grace Period, the Membership Service benefits will be suspended or terminated. After suspension, the member may update the payment method or resubscribe to use the Membership Service again.
③ The duration and handling of reattempted payments may vary depending on the policies of the App Market Operator.
④ The responsibility for maintaining valid payment information and preventing payment failure lies with the Membership Member, and the Company shall not be liable for service interruptions caused by payment failure.
Chapter 3 Contents of the Membership Service
Article 8 [Contents and Benefits of the Membership Service]
① The Membership Service is an auto-renewing subscription product that provides premium features, including an ad-free viewing environment, to Membership Members who have paid the Membership Fee within the Mnet Plus service (hereinafter the "Service").
② The benefits of the Membership Service include the following, and detailed scope and usage methods for each benefit may be confirmed on the service information page.[S&K2]
1. Removal of video advertisements (however, advertisements included within content, persistent fixed advertisements, or advertisements that cannot be removed due to copyright policies may be excluded)
2. Removal of voting advertisements
3. Provision of high-definition video (however, actual quality may vary depending on original content resolution and network/device environment, and such degradation does not constitute a defect of the Membership Service)
4. External app PIP (Picture-in-Picture) functionality (however, in-app PIP is provided as a basic feature regardless of membership)
5. Regular provision of Mplus Points (details such as quantity, usage, and expiration conditions may be confirmed on the service information page)
③ The Company may, at its discretion, provide additional benefits (hereinafter “Additional Benefits[S&K3]”) occasionally or irregularly based on operational policies or content/IP contract conditions. Additional Benefits are not essential components of the Membership Service, and the Company may change or discontinue them without prior notice. Members may not request cancellation or refund due to changes or discontinuation of Additional Benefits.
④ Membership benefits belong to the member’s account and may not be transferred, lent, or shared.
⑤ Membership benefits are provided only during the subscription period and will cease upon termination or expiration of the agreement.
Article 9 [Changes to Benefits and Pricing]
① The Company may change the composition of Membership benefits or Membership Fees for reasonable reasons such as operational or technical necessity, changes in laws, or partner policies.
② If such changes occur, the Company will notify at least 30 days prior to the effective date and individually notify members via contact information (SMS/email). Minor changes will be announced at least 7 days in advance.
③ Membership Members who do not agree to the changes may cancel the Membership Service before the effective date of the change. If the effective date of the change is after the expiration of the current Subscription Period, the Member may use the Membership Service until the expiration of the current Subscription Period, after which the service agreement shall be terminated. If the effective date of the change is before the expiration of the current Subscription Period, the service agreement shall be terminated as of the effective date of the change, and the Membership Fee shall be refunded on a pro-rata basis for the remaining Subscription Period. In such case, the pro-rata refund amount shall be calculated by dividing the applicable Membership Fee by the total number of days in the applicable Subscription Period and multiplying by the number of remaining days.
④ Notwithstanding Paragraphs 1 and 2, in the case of an increase in the Membership Fee, the Company shall request the consent of Membership Members within 30 days prior to the billing period to which the changed fee applies. If a Membership Member does not consent to the changed fee, the regular payment of the relevant Membership Member shall not be automatically renewed and shall be terminated at the end of the current Subscription Period for which payment has already been made.
Article 10 [Service Termination]
① If the Company intends to terminate the Membership Service, the Company shall provide notice within the service and notify Membership Members at least 30 days prior to the scheduled termination date.
② In the case of service termination pursuant to Paragraph 1, the Company guarantees the use of the Subscription Period for which the Membership Member last made payment prior to the service termination date. However, if the service termination date is before the expiration of the current Subscription Period, the Company shall refund the amount corresponding to the remaining Subscription Period as of the service termination date on a pro-rata basis. In such case, the pro-rata refund amount shall be calculated by dividing the applicable Membership Fee by the total number of days in the applicable Subscription Period and multiplying by the number of remaining days.
③ Upon termination of the Membership Service agreement due to service termination, the Membership benefits may no longer be used. However, a separate grace period for the expiration of remaining MplePoint as of the service termination date may be established and operated, and details thereof shall be announced together with the service termination notice.
Article 11 [Member Obligations and Prohibited Acts]
① Membership Members must comply with the obligations set forth in these Terms and Conditions and the Basic Terms.
② Membership Members shall not transfer, lend, or otherwise permit the use of their rights to use the Membership Service to any other person.
③ If a Membership Member violates the obligations set forth in this Article and causes damage to the Company or any third party, the relevant Membership Member shall be liable to compensate for such damages.
Article 12 [Service Provision and Limitation of Liability]
① The Company shall make its best efforts to provide the Membership Service in a stable manner. However, the Company shall not be liable in cases corresponding to the grounds for exemption from liability set forth in the Basic Terms with respect to service interruptions, etc.
② The Company may provide Membership Members with services or content provided by third parties as Membership benefits. Unless attributable to the Company, the Company shall not in principle be liable for any problems arising to Membership Members due to services or content provided by third parties.
Chapter 4. Withdrawal of Subscription, Cancellation, and Refund
Article 13 [Member's Cancellation and Subscription Termination]
① Membership Members may cancel (apply for termination of) their Membership Service subscription at any time.
② In the case of enrollment through IAP, subscription cancellation must be processed directly through the subscription management menu within the account settings of the relevant App Market Operator (App Store or Google Play, etc.).
③ The effect of subscription cancellation takes place at the time of expiration of the current Subscription Period, and the Membership Member may continue to use the benefits of the Membership Service until the expiration of the current Subscription Period. Upon expiration of the Subscription Period, the provision of Membership Service benefits will be suspended.
④ Partial refunds for mid-term cancellation of already-paid Membership Fees shall not be provided.
⑤ Membership Members may withdraw their subscription cancellation application before the expiration of the current Subscription Period even after having applied for subscription cancellation. [S&K5]
Article 14 [Withdrawal of Subscription Application]
① A Membership Member may withdraw their subscription application if all of the following requirements are met:
1. Within seven (7) days from the date of payment of the membership fee; and
2. The membership benefits have not been used.
② Upon withdrawal of a subscription application, the Membership Service agreement shall be immediately terminated and the Company shall refund the full amount of the Membership Fee paid. However, in the case of payment made through IAP, refunds shall be primarily processed in accordance with the refund policies and procedures of the relevant App Market Operator.
③ Withdrawal of a subscription application shall be restricted in any of the following cases:
1. Where seven (7) days have elapsed from the date of payment of the membership fee; or
2. Where any membership benefit has been used at least once.
④ Notwithstanding Paragraph 3, where the content of the membership service differs from the content indicated or advertised within the service, or is performed inconsistently with the contract, the Membership Member may withdraw the subscription within thirty (30) days from the date on which such fact became known or could have been known, and within three (3) months from the date of payment of the membership fee.
Article 15 [Company’s Termination]
① The Company may, after prior notice to the Membership Member, terminate the Membership Service agreement or restrict the use of the Membership Service if the Membership Member violates these Terms and Conditions or if grounds for termination set forth in the Basic Terms exist. However, if immediate action is required, termination or restriction of use may be made without prior notice.
② If the Company terminates the Membership Service agreement due to reasons attributable to the member pursuant to Paragraph 1, the Company shall refund the remaining amount after deducting from the Membership Fee the amount corresponding to the number of days the Membership Member used the service (the pro-rata daily amount calculated by dividing the Membership Fee for the applicable Subscription Period by the total number of days in the Subscription Period, multiplied by the number of days used) and a penalty (an amount equivalent to 10% of the Membership Fee).
③ With respect to the Company's termination and restriction of use, the Membership Member may file an objection in accordance with the procedures established by the Company, and if the Company acknowledges the objection to be justified, the Company shall immediately resume the provision of the service.
Article 16 [Effects of Termination/Expiration]
① Upon termination or expiration of the Membership Service agreement, the timing of suspension of benefit provision by subscription status is as follows:
1. Member's subscription cancellation: suspension of benefit provision at the time of expiration of the Subscription Period;
2. Benefit suspension due to payment failure: immediate suspension of benefit provision at the time of expiration of the Grace Period pursuant to Article 7, Paragraph 2;
3. Company's termination: suspension of benefit provision from the time of the Company's termination notice or the time separately designated by the Company.
② If the Membership Service agreement is terminated due to withdrawal of subscription application or refund, the MplePoint that have been provided shall be immediately retrieved. In the case of subscription cancellation, MplePoint already provided may continue to be used until the designated validity period.
Chapter 5. Miscellaneous
Article 17 [Amendment to Terms and Conditions and Method of Notification]
① The Company may amend these Terms and Conditions within the scope not in violation of applicable laws and regulations, and the method of amendment and the effective date of the Terms and Conditions shall be governed mutatis mutandis by the amendment procedures set forth in the Basic Terms. In the case of amendments to the Terms and Conditions that are unfavorable to or have a significant impact on Membership Members, notice shall be provided from 30 days prior to the effective date, and separate notification shall be made to the Membership Member's email address or contact information (e.g., text message).
② If a Membership Member does not agree to the content of the amended Terms and Conditions, the Member may cancel the Membership Service. If the effective date of the amended Terms and Conditions is before the expiration of the current Subscription Period, the service agreement shall be terminated as of the effective date of the amended Terms and Conditions, and the Membership Fee shall be refunded on a pro-rata basis for the remaining Subscription Period. In such case, the pro-rata refund amount shall be calculated by dividing the applicable Membership Fee by the total number of days in the applicable Subscription Period and multiplying by the number of remaining days.
Article 18 [Dispute Resolution and Governing Law]
The governing law and jurisdiction for disputes related to these Terms and Conditions shall be governed mutatis mutandis by the provisions of the Basic Terms. However, if the laws or regulations of a specific country or region take precedence, such laws or regulations shall apply.
